No Win, No Fee
Legal aid for personal injury claims is only available in very exceptional circumstances, which has brought about the rise of Conditional Fee Agreements (commonly known as ‘no win, no fee’ agreements). These agreements are permitted by the Access to Justice Act 1999 and in accordance with that Act you will be required to sign a conditional fee agreement. That agreement puts the arrangement on a formal footing thus allowing us to recover our fees from the other party if your claim succeeds.
If your claim fails, we do not get paid. We are happy to pursue most personal injury claims (except criminal injury cases) on this basis as long as the claim has a reasonable prospect of success. This basis of funding places the risk entirely with us, you the client having absolutely nothing to lose.
In a few cases, the defendants strongly deny liability. This may necessitate the issuing of court proceedings. It is therefore necessary to take out insurance against the other party's costs which are payable if the claim fails. We can arrange this insurance for you.
We can also finance other disbursements such as the fees charged by medical experts, engineers and enquiry agents. This means that in most cases no expenses are payable by you. In any event, upon successful conclusion of the claim we can recover these disbursements, including the insurance premium, from the other party.
You may have the benefit of legal expenses insurance as part of your motor or house insurance policy. You may even have insurance supplied with your credit card, or, if you are a member of a Trade Union, from the Union. The insurers may try to insist that you use their panel solicitors, but you should not accept this. We would be happy to give you free advice concerning this.
If you have an insurance policy that provides legal expenses cover, we can act for you under this policy, rather than entering into a conditional fee agreement and a separate insurance policy.
