Accidents on Holiday
Accidents can occur whether you are holidaying at home or abroad. There are many ways accidents can occur during a holiday, and it can often be quite daunting, particularly if the accident takes place in another country.
If you suffer an accident whilst on holiday in England or Wales (Scotland and Northern Ireland have similar provisions), which is not your fault, then you may have a claim against the owner of the holiday accommodation or the tour operator (if booked as a package), if your accident occurred whilst on the property.
If you have suffered injury whilst on an organised excursion, sporting or other activity, you may also have a claim against the organiser of the excursion/activity.
If you suffer from any illness as a result of poor hygiene, contaminated foodstuffs/water or food standards in any eating establishments, again you may be able to make claim, although your solicitor will be able to advise you further.
Accidents on holiday are more common than you may think and many holidaymakers come home with a personal injury and don't ever take any action against the guilty party. If you suffer an accident whilst abroad, your holiday company, airline, hotel or excursion organiser will nearly always have a duty to ensure your safety. If they breach that duty you may have a holiday injury claim against them.
In many instances, particularly if you have booked a package holiday, you are able to bring a claim against the travel company in the UK, even if your accident happened abroad, rather than having to sue the hotel owner in a foreign country.
